This policy covers both licensees of Tessitura Software and members of the Tessitura Network, Inc. (“Tessitura”) utilizing the website (“Licensees”) and visitors to the website who are not licensees.

Password Protected Section of the Website
Access to the password protected section of the website (“Licensee Section”) is restricted to such person(s) who are licensees of Tessitura Software or employees of Tessitura or those separately authorized for entry by Tessitura.
Passwords are issued on a per person basis and may be used only by the individual to whom the password is issued. All persons who access the Licensee Section agree to not share with or provide access to this Section or share their password with anyone else, and also agree to not discuss pricing practices, terms or similar issues.
Licensees are responsible for maintaining the security of any passwords issued by Tessitura to their employees and agree to promptly notify Tessitura in the event of a misappropriation or unauthorized disclosure of a password to a third party.
Email Subscription Management
As a member of Tessitura Network, you will automatically be signed up to receive Tessitura Network business and education email communications. If you choose to opt out of these lists, you may do so at any time by managing the “Subscriptions” area on this website’s logged in My Account page, or from the “unsubscribe” mechanism at the bottom of all Tessitura Network email.
You agree not to distribute or share any information made available to you on the website except and solely to the extent reasonably necessary to operate your business in the ordinary course and consistent with any terms to which the information is expressly made subject where posted, any other agreements, such as licenses for the Tessitura Software or as restricted by applicable confidentiality agreements. You further agree not to use, rent, or sell for marketing or other commercial purposes any data obtained from this website including user addresses, and any user web postings including comments or statements.
An Internet protocol (“IP”) address is a numeric code, for example, “220.127.116.11.” This code is used to communicate between your Internet service provider and the World Wide Web. The IP address does not identify you individually. Tessitura logs inbound IP addresses to administer our website and to compile aggregate information on site traffic for internal use.

PRIVACY PRINCIPLES: The privacy principles listed below are based on the Safe Harbor Principles.
NOTICE: Where Tessitura collects personal information directly from individuals in the EEA, Tessitura does not use or disclose the information for a purpose other than that for which it was originally collected nor does Tessitura disclose information to any third party other than subcontractors of Tessitura Network, Inc. who are bound to the same obligations of confidentiality. Where Tessitura provides data processing services to members through our RAMP or RADR programs, Tessitura acts only as a processor of the data and not the data collector. Such data collectors are required to comply with all applicable EU Member State Data Protection regime, thereby ensuring the data subjects have been provided with proper notice regarding how their personal data will be used.
CHOICE: As stated above, Tessitura does not use or disclose personal information to any third party. For purposes of these standards, opt-out is the default and only choice.
DATA INTEGRITY: Tessitura will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. Tessitura will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current. ENFORCEMENT: Tessitura will conduct compliance audits of its relevant privacy practices to verify adherence to this Policy. Any employee that Tessitura determines to have intentionally violated this policy will be subject to disciplinary action up to and including termination of employment.
DISPUTE RESOLUTION: Any questions or concerns regarding the use or disclosure of personal information should be directed to the address given below. Tessitura will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with the principles contained in this Policy. For complaints that cannot be resolved between Tessitura and the complainant, Tessitura has agreed to participate in the dispute resolution procedures of the American Arbitration Association pursuant to the Safe Harbor Principles.
LIMITATIONS ON APPLICATION OF PRINCIPLES: Adherence by Tessitura to these Safe Harbor Principles may be limited (a) to the extent required or permitted by law or legal process, such as to respond to or investigate a legal or ethical obligation or request or pursuant to court orders, subpoenas, interrogatories or similar directive carrying the force of law; and (b) to the extent expressly permitted by an applicable law, rule or regulation.
